Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus to direct the respondent herein to consider and pass orders on the petitioners application dated 22.05.2024 for the grant of Maxi Cab van permit in respect of Vehicle Number TN18-H5682, forthwith. By consent of both sides, this Writ Petition is disposed of at the stage of admission itself.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondent and perused the materials available on record.

3. The case of the petitioner is that he purchased the second hand maxi cab van bearing registration No.TN-18-H-5682 from one Siva, Ennore during the month of April 2024. On 22.05.2024, the petitioner applied for fresh maxi cab permit for the vehicle before the respondent in the prescribed format and paid the fees. The respondent received the application on 23.05.2024, till date permit was not issued to the petitioner. Thereafter, the petitioner sent a reminder to the respondent on 22.06.2024, but till date permit has not been issued to the petitioner's van. Hence, the present writ petition.

4. When the matter is taken up for hearing the learned Special Government Pleader representing the respondent filed a report stating that the respondent has sent a communication to the petitioner on 27.05.2024 for production of the vehicle with valid records for taking further action. The 2/4

erstwhile owner of the vehicle had surrendered the permit to the respondent on 13.10.2022. Further the fitness certificate of the vehicle for permit has been renewed upto 15.03.2023 and the tax for the vehicle has been paid in part instead of life time tax. The learned counsel further submits that if the petitioner approaches the respondent with all requisite documents and produce the vehicle the same will be considered.

Considering the facts of the case, this Court directs the petitioner to produce all the documents and the vehicle before the respondent for granting permit to the maxi cab van bearing Registration No.TN-18-H-5682 within a period of two weeks from the date of receipt of copy of this order. The respondent is directed to consider and pass appropriate orders within a period of four weeks, thereon.

6. With the above direction, this Writ Petition is disposed of. No costs.
