The instant application has been filed by the applicant/plaintiff with a prayer to punish the respondent for committing contempt of the order passed by this Court dated 08.03.2022 in A.No.350 of 2022 in C.S.No.59 of 2021.

According to the applicant, this Court by order dated 08.03.2022 in A.No.350 of 2022, directed the respondent to deposit a sum of Rs. 15 Crore (Rupees Fifteen Crore) to the credit of the suit and the said direction has not been complied by the respondent and consequently, he should be punished for his failure to obey the order passed by this Court directed him to deposit the amount.

The learned counsel for the respondent brought to the notice of this Court that challenging the order passed in A.No.350 of 2022, the respondent herein filed the appeal in O.S.A.(CAD).No.73 of 2022 and the Hon'ble Division Bench disposed of the said appeal by modifying the order of the learned Single Judge. A perusal of the order passed in
O.S.A.(CAD).No.73 of 2022 would indicate that the Hon'ble Division Bench, at the time of disposing of the Original Side Appeal clarified that in case of failure of the respondent to comply with the directions issued to him to deposit the amount, there shall be an order of injunction against the respondent from in any manner releasing the movie.

In view of the order passed by the Hon'ble Division Bench in O.S.A.(CAD).No.73 of 2022 indicating the consequence of failure of the respondent to deposit the amount as directed in A.No.350 of 2022, the submission made by the learned counsel for the applicant that the respondent shall be punished for his failure to deposit the amount as directed by the learned Single Judge cannot be countenanced.
