Mr.R.Neelakandan, Additional Advocate General Assisted by Mr.T.M.Rajangam, Government Advocate for R1 and R2
ORDER
This writ petition has been filed for the issue of writ of Mandamus directing the 2 nd respondent to act upon the representation made by the petitioner on 09.05.2025 wherein the petitioner is seeking for adding her name in the legal heirship certificate of deceased Ponnurangan. 2.
Heard M/s.Tamil Selvi, learned counsel for the petitioner and Mr.R.Neelakandan, learned Additional Advocate General Assisted by Mr.T.M.Rajangam, learned Government Advocate for Respondents 1 and 2. 3.
The grievance of the petitioner is that her father Ponnurangam died intestate on 21.11.1996 leaving behind eight legal heirs. Thereafter, the petitioner's mother also died on 23.03.2021. The grievance of the petitioner is that her name is not added in the legal heirship certificate, based on the
objections given by her brother Selvaraj, who is not co-operating in giving the Aadhar card of the petitioner.
4.
The learned Additional Advocate General based on the written instructions received from the 2 nd respondent submitted that three of the legal heirs had submitted their Aadhar card and others did not even submit a single document to establish their relationship between the said Ponnurangam and his wife Rajammal. That apart, objections were also raised by one Selvaraj and he is not co-operating. In view of the same, the 2 nd respondent is not in a position to process the application submitted for legal heirship certificate. Accordingly, it was also rejected.
5.
The learned counsel for the petitioner submitted that the petitioner has valid documents to establish her relationship as the daughter of late Ponnurangam.
6.
Taking into consideration the submissions made on either side and the materials available on record, it is made clear that the petitioner can produce any valid document before the 2 nd respondent to establish her relationship with late Ponnurangam, who is claimed to be the father of the petitioner. If the petitioner application was already rejected, a fresh on-line application shall be submitted along with the relevant documents and also by paying the necessary charges. The same shall be considered by the 2 nd respondent and the legal heir
ship certificate shall be issued within a period of four weeks from the date of receipt of the application from the petitioner. 7.
This writ petition is disposed of with the above directions. No costs.
