Though the application has been vehemently contested by Mr. R. Ramanlal, learned counsel appearing for the respondent, however it is seen that the written statement was originally filed in the month of October 2007 itself (the very same year the Suit has been filed), the same was returned and thereafter the counsel was not able to take the return and represent the same, as a result of which, the delay has crept in. In fact, non filing of written statement was noted only when the matter was listed before this Court.

2. Considering the above reasons, I am of the view that the delay has to be condoned and the written statement has to be taken on file. Therefore, the delay is condoned and the written statement is taken on file. 10.12.2020 mrn http://www.judis.nic.in
