ORDER

The Writ Petition has been filed to forbear the respondents 1 to 3 from mutation of patta in favour of the respondents 4 & 5 in respect of property in S.F.No.86/1A5, Kannentheri Village, Sankari Taluk, Salem District on the basis of the first respondent proceedings in Na.Ka.No.1917/2021(C) dated 25.08.2021 by considering the petitioner's representation dated 06.09.2021.

2.Heard Mr.R.Marudhachalamurthy, learned counsel appearing for the petitioner and Mr.P.Balathandayutham, learned Special Government Pleader appearing for the respondents 1 to 3. 3.The learned Special Government Pleader appearing for the respondents 1 to 3 would submit that while pending this Writ Petition, the respondents 4 & 5 submitted representation before the first respondent for issuance of patta in respect of the property comprised in S.F.No.86/1A5, situated at Kannentheri Village, Sankari Taluk, Salem District. On receipt of the same the first respondent conducted detailed enquiry and by an order dated 27.09.2021, rejected the claim of the respondents 4 & 5 herein, for the reason that a civil suit is pending between the parties in O.S.No.221 of 2020 on the file of the Subordinate Court, Sankari.

4.Recording the said submission, the Writ Petition is closed. Consequently, connected miscellaneous petition is also closed. There shall be no order as to costs.
