O R D E R

By the impugned order, direct payment was ordered as against the petitioner, which is aided School on two grounds, first is that despite the instructions given the Headmistress of the School was neither taken back nor paid the subsistence allowance. The second reason was that there is no approval by the School Committee and there is a dispute pending between the parties. By virtue of the interim order, the impugned order has been put in abeyance. https://hcservices.ecourts.gov.in/hcservices/

2. Learned counsel appearing for the petitioner submitted that both the reasons assigned in the impugned order do not stand as on today and the dispute is settled now. The teacher has challenged proceedings of the 2nd respondent before this Court and appropriate orders are passed. Therefore, the said dispute no longer survives and insofar as the approval of the School Committee is concerned, the School Committee itself has been changed and the same has been approved by the Educational authorities. In view of the above said factual submission nothing survives for adjudication in this writ petition.

3. Accordingly, the order impugned is set aside and the writ petition is allowed. Consequently, connected W.P.M.P.Nos.13762 and 2223 of 2003 are closed.
