O R D E R

This Civil Miscellaneous Petition has been filed seeking extension of time for the Trial Court to dispose of I.A.No.2 of 2025 in H.M.O.P.No.3762 of 2024, pending on the file of the III Additional Family Court, Chennai.

2.This Court by its order dated 14.05.2026, passed in C.R.P.No.3037 of 2026, directed the III Additional Family Court to dispose of I.A.No.2 of 2025 in H.M.O.P.No.3762 of 2024 within a period of two weeks from the date of receipt of a copy of the said order. I.A.No.2 of 2025 in H.M.O.P.No.3762 of 2024 was filed by the respondent in this Civil Revision Petition against the petitioner, seeking for interim maintenance. The respondent is the wife and the petitioner is her husband. According to the petitioner, the respondent had suppressed material facts in C.R.P.No.3037 of 2026 and by suppression of those material facts, had obtained an order on 14.05.2026 from this Court, directing the III Additional Family Court, Chennai, to dispose of I.A.No.2 of 2025 in H.M.O.P.NO.3762 of 2024, within a period of two weeks from the date of receipt of a copy of the said order.

3.According to the petitioner, the order dated 14.05.2026 passed in C.R.P.No.3037 of 2026, was received by the III Additional Family Court, two weeks before this date. Therefore, the time fixed by this Court for the disposal of I.A.No.2 of 2025 in H.M.O.P.No.3762 of 2024 in this Court's order dated 14.05.2026 will get expired on 10.06.2026. Till date, the Trial Court namely the III Additional Family Court, Chennai, has not made any request to the Registry of this Court seeking extension of time for disposal of I.A.No.2 of 2025 in H.M.O.P.No.3762 of 2024 and has not expressed its difficulty to dispose of the

said I.A., within the time frame fixed by this Court in its order dated 14.05.2026, passed in this Civil Revision Petition. However, the learned counsel for the petitioner would submit that the respondent/petitioner had suppressed the pendency of Sub Applications filed in I.A.No.2 of 2025 in H.M.O.P.No.3762 of 2024 and by suppression of those material facts, the respondent/petitioner had obtained an order from this Court on 14.05.2026, for disposal of I.A.No.2 of 2025 in H.M.O.P.No.3762 of 2024, within a period of two weeks from the date of receipt of a copy of the said order. When the III Additional Family Court has not till date sought extension of time for pronouncing of the order in I.A.No.2 of 2025 in H.M.O.P.No.3762 of 2024, the question of permitting the husband who is the petitioner in this C.M.P, seeking extension of time for the III Additional Family Court, Chennai, to dispose of I.A.No.2 of 2025 in H.M.O.P.No.3762 of 2024 does not arise and is not maintainable.

4.The learned Senior Counsel appearing for the respondent/petitioner also would submit that till date, no interim maintenance has been paid to the respondent/petitioner, who is the wife.

5.This Court is not expressing any opinion on the merits of the respective contentions. But, however, this Court is of the considered view that this Petition

filed by the petitioner/respondent is not maintainable since the Judicial Officer concerned namely the III Additional Family Court Judge, Chennai, has not sought for any extension of time for pronouncing the order in I.A.No.2 of 2025 in H.M.O.P.No.3762 of 2024, which was filed by the respondent/petitioner for interim maintenance and if at all, it is for the Judicial Officer to make a request before this Court that it is not possible to dispose of I.A.No.2 of 2025 in H.M.O.P.No.3762 of 2024 within a period of two weeks from the date of receipt of a copy of the said order as directed by this Court on 14.05.2026 in this Civil Revision Petition. The suppression of material facts which the petitioner has pleaded in this extension petition will have to be considered only by the III Additional Family Court, Chennai, who is dealing with I.A.No.

2 of 2025 in H.M.O.P.No.3762 of 2024 and not by this Court in this Civil Revision Petition. Without expressing any opinion on the merits of the respective contentions of the respective parties before this Court, this Court is not entertaining this C.M.P. due to the reasons stated supra.

6.Accordingly, this Civil Miscellaneous Petition is dismissed. No costs. 08-06-2026 Index : Yes/No GSA
