The petitioner herein is the successful bidder in the tender floated by the local body for providing CC pavement at AD Colony Arasamara Street in Pasumathur Panchayat at K.V.Kuppam Block and construction of drainage at Nagal New Colony in Nagal Panchayat for K.V. Kuppam Block, alleging that the private respondents are preventing him from carrying on the tender work claiming additional work which does not form part of the tender seeks Police protection to complete the tender work.

2. The learned Counsel appearing for the private respondents submitted that the petitioner was not inclined to carry out the work as per the tender specification but trying to lay a substandard road, hence that was objected. To ascertain whether the petitioner has intended to carry out the work as per the specification and the demand of the private respondent is whether in tune with the tender specification, this Court directed the learned counsel for the petitioner to produce the description of the work of the subject tender. The learned counsel appearing for the petitioner has furnished the copy of the description of the work which forms part of the tender.
3. The learned counsel appearing for the private respondents states that if the petitioner is ready to carry out the work as per the specification, the private respondents have no objection.
4. The learned Government Advocate (Crl. Side) confirms that if necessary protection will be given to the petitioner to carry out the work as per the tender specification and the work shall be done under the supervision of the Block Development Officer and the protection is sought by the BDO for execution of the work.

5. Recording the above undertaking, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
