A.No.3736 of 2024 in O.P.No.735 of 2023 RMT.TEEKAA RAMAN,J.

This application has been filed praying to grant leave to receive the list of schedule mentioned additional documents viz., 1 to 12 and mark the same as exhibits.

2. The learned counsel for both sides are present before this Court.

3. The learned counsel for the applicant prayed to this Court that leave may be granted to mark all the 12 documents mentioned in the schedule.

4. The learned counsel for the respondent raised objections with regard to various vouchers which has been marked as Document No.1 and submitted that it is a forged document.

5. With regard to Document No.1 the learned counsel for the respondent has made a clear stand that the said document is forged. Hence, subject to the proof and relevancy, he is at liberty to cross

examine and take out necessary application to prove the genuinity of the document and it is for the applicant to lead evidence accordingly.

6. On perusal of the documents mentioned in the schedule, I find that Document No.10 is a medical certificate issued by Dr.Shantha Kamath and it cannot be marked without examining the said doctor. Hence, except Document No.10, all other documents are permitted to be marked by P.W.1 and subject to the examination of Dr.Santha Kamath, Document no. 10 is permitted to be marked.

7. Accordingly, this application is ordered to the extent indicated above.
