PRAYER: Criminal Original Petition has been filed under Section 482 of the Code of Criminal Procedure, to restrain the respondent from harassing the petitioner.

ORDER

The criminal original petition has been filed to restrain the respondent from harassing the petitioner. 2.The petitioner submits that for his son's marriage, he borrowed a sum of Rs.11,00,000/- on 09.09.2019 from one S.Kothandan, who is residing in Anna Nagar, Chennai. Due to the prevailing pandemic situation, he is unable to mobilize the fund as promised and not return the same, for which, the complaint. In this regard, the petitioner has been unnecessarily harassed. 3.The learned Government Advocate (Crl.side) submits that one S.Kothandan lodged a complaint against the petitioner stating that the petitioner had borrowed a sum of Rs.11,00,000/-, not returned and cheated him. He further submits that the petitioner is needed for enquiry.

4.The counsel for the petitioner submits that the petitioner is ready and willing to appear before the respondent police. 5.On perusal of the materials, it is seen that the petitioner himself admits that on 09.09.2019, he had borrowed a sum of Rs.11,00,000/- from S.Kothandan for the purpose of conducting his son's marriage. In this regard, calling the petitioner for enquiry by the respondent police would not amount to harassment and the Court directs the petitioner to appear before the respondent police on 11.10.2021 and thereafter. 6.With the above direction, the criminal original petition is disposed of.
