Crl.O.P.No.15356 of 2023 G.CHANDRASEKHARAN.J., The petitioners, who were arrested and remanded to judicial custody on 11.06.2023 for the offences punishable under Sections 294(b), 323, 387, 506(ii) of IPC in Crime No.178 of 2023 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioners submitted that, petitioners submitted that, petitioners are falsely implicated in a case registered in Crime No. 178 of 2023 for the offences under Sections 294(b), 323, 387, 506(ii) of IPC. Petitioner is in Judicial Custody from 11.06.2023. Thus, he seeks bail to the petitioner.

3. In response, learned Government Advocate (Crl. Side) submitted that, petitioner and other accused had way laid the defacto complainant and taken a sum of Rs.5,000/- from him. He further submitted that, apart from this case, there is one similar previous case pending against the petitioners. Investigation in this case is pending and hence he opposed for grant of bail to the petitioners. 1/3

4. Considering the nature of the offence alleged to have been committed by the petitioners and also the fact that there is similar previous cases pending against the petitioners and also the fact that investigation is not completed, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original petition is dismissed. 11.07.2023 Sma 2/3
