O R D E R

The petitioner, who was arrested and remanded to judicial custody on 26.03.2025, for the offences punishable under Sections 5(l), 5(j)(ii) r/w 6 of POCSO Act, 2012 in connection with Crime No.18 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that the petitioner on the false promise of marriage, had sexual intercourse with the de-facto complainant, a minor girl, thereby she became pregnant. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner and the victim girl had a love affair and victim later became pregnant. When she went to the hospital for medical examination her pregnancy confirmed. Since she was found to be a minor, a case was registered. 2/4

4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioner is a married man having female child of 3 years old. The petitioner taking advantage of the victim girl's loneliness, entered into the house and committed penetrative sexual assault on the victim not once but on several occasions, due to which, the victim became pregnant. Now she also delivered a baby. Hence, he strongly opposed for granting bail to the petitioner.

5.In view of the above, this Court is not inclined to entertain this bail application and the same is dismissed.
