The matter is listed today upon being mentioned. Learned counsel for the petitioner has placed before me a communication from Mr.Roshan K.Balasubramanian, Advocate, who was appointed as the sole arbitrator by order dated 09.02.2023. In such communication, he has indicated that he is not in a position to act as the sole arbitrator.

2. Both parties agree to the appointment of Mr.Ramasubramanian Raja, Advocate, Pent House, Fourth Floor, Corddel Apartments - 29, Pycrofts Garden Road, Nungambakkam, Chennai - 600 006, Mobile No.9500082400 as the sole arbitrator. Consequently, he is appointed as the sole arbitrator and called upon to enter upon reference and adjudicate the case. The fees and expenses in relation to the arbitral proceedings shall be fixed by the arbitral tribunal in consultation with the parties.
