Criminal Original Petition is filed under Section 439 (1) (b) of Cr.P.C. praying to modify the condition imposed the order dated 20.06.2023 in Crl.M.P.No.1253 of 2023 by the Learned District and Sessions Judge, District and Sessions Court No.II, Kancheepuram District. "That the petitioner has to appear before Respondent Police on alternative days at 10.00 A.M. for 30 days" to sign before the concerned court namely Judicial Magistrate No.II, Thiruvallur. ORDER

This petition has been filed to modify the condition imposed the order dated 20.06.2023 in Crl.M.P.No.1253 of 2023 by the Learned District and Sessions Judge, District and Sessions Court No.II, Kancheepuram District. "That the petitioner has to appear before Respondent Police on alternative days at 10.00 A.M. for 30 days" to sign before the concerned court namely Judicial Magistrate No.II, Thiruvallur. 2.The learned counsel for the petitioner submitted that the petitioner was granted bail in Crl.M.P.1253 of 2023 on 20.06.2023 by the learned District and Sessions Judge, District and Sessions Court No.II, Kancheepuram District. While granting bail, the learned District and Sessions Judge, District and Sessions Court No.II, Kancheepuram District, directed the petitioner to appear before Respondent Police on alternative days at 10.00 A.M. for 30 days and thereafter on summons. Petitioner apprehends danger to his life within the jurisdiction of Sriperumbudur Police Station. Thus, this petition is filed for modification.

3.The learned Government Advocate (Criminal side) submitted that the case is pending in P.R.C.No.28 of 2023 and petitioner may be directed to appear before the learned Judicial Magistrate, Sriperumbudur. 4.Thus, the third condition in order dated 20.06.2023 in Crl.M.P.1253 of 2023 is modified to the effect that petitioner shall appear before the learned Judicial Magistrate, Sriperumbudur, on every Monday for four weeks at 10.00 A.M. and then on the date of hearings without fail.
