Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to setaside the docket order dated 08.07.2019 returning the application vide unnumbered Crl.MP.SR No.1631 of 2019 in Crl MP No.804 of 2019 passed by the Court of Principal District and Sessions Judge, Erode District and relax the condition.

This petition has been filed challenging the order passed by the Court below refusing to relax the condition imposed on the petitioners while granting Anticipatory bail to the petitioners. 2.
The Court below while granting anticipatory bail to the petitioners had imposed a condition to the effect that the petitioners should appear before the learned Judicial Magistrate No.1, Gobichettipalayam daily at 5.00 p.m for a period of 30 days. The petitioners had complied with this condition from 21.06.2019 for some time. Since the 1st petitioner is a practicing Advocate, and the 2nd petitioner is doing business, they had sought for relaxation of this condition on the ground that they are not in a position to comply with the condition due https://hcservices.ecourts.gov.in/hcservices/
to the nature of their work.

The Court below refused to relax the condition and aggrieved by the same, the present petition has been filed before this Court.

Taking into consideration the facts and circumstances of the case, this Court is inclined to relax the condition imposed on the petitioners to the extent that the petitioners shall report before the respondent police, as and when required during investigation.

This Criminal Original petition is disposed of accordingly.
