The instant writ petition has been filed with a prayer for issuing a mandamus to direct the respondents to consider the petitioner's representation dated 07.05.2024 in respect of notional promotion to the post of Forester on par with his juniors (i.e., 13.04.2013) by including him in the panel for the post of Forester for the year 2011-2012, without insisting on completion of Vaigai Dam Training within the specified period on 15.08.2016, in the light of the order passed by this Court in W.P.No.40881 of 2016 dated 22.11.2016, which was affirmed by the Division Bench in W.A.No.2682 of 2019 and confirmed by the Hon'ble Supreme Court in SLP (Civil) Diary No.(S) 27674 of 2022 dated 26.09.2022, and in the light of the order in W.P.No.7511 of 2/6
2025 dated 28.04.2025, with all consequential service and monetary benefits.
2. The learned counsel for the petitioner would submit that he was appointed as Plot Watcher on a daily wage basis on 01.08.1981. Thereafter, the petitioner's service came to be regularized in the cadre of Forest Watcher on 21.05.2008. It is the further submission of the learned counsel for the petitioner that despite his long service, he was not considered for promotion though his juniors were given promotion. Hence, he preferred a Writ Petition and based upon the order passed in the Writ Petition, he was promoted as Forest Watcher.
2.1. It is the further submission of the learned counsel for the petitioner that again when the respondents did not consider the petitioner for promotion to the post of Forest Guard, he preferred another Writ Petition, and in pursuance of the order passed by this Court, he was promoted to the post of Forest Guard. However, for the next avenue of promotion, viz., Forester, though the petitioner's juniors were promoted, he was not considered for the same. Hence, he has given a representation dated 07.05.2024 to promote him notionally with effect from the date when his immediate junior was promoted 3/6
to the post of Forester, and such representation is pending with the respondents.
3. At this juncture, the learned Special Government Pleader appearing for the respondents would fairly submit that they would consider the said representation and pass orders within a reasonable time.
4. Heard the learned counsel for both sides and perused the materials available on record.
5. In such view of the matter, without going to the merits of this Writ Petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 07.05.2024 and pass orders on its own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
6. In the result, this Writ Petition is disposed of with the above 4/6
observations. No costs.
