CRIME NO.594 OF 2013 Petitions praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL.RC.NO.455 OF 2018 on the file of the High Court, the High Court will be pleased to [i] suspend the sentence imposed in CC No.2/2014 on the file of Judicial Magistrate No.VI, Salem by a judgment dated 06.07.2017 and the same was confirmed by the III Additional Sessions Judge, Salem in C.A.No.89 of 2017 by a judgment dated 24.01.2018 pending disposal of Criminal Revision CRL.RC.NO.455 OF 2018[ IN CRL.MP.NO.5521 OF 2018] [ii] exempt the petitioner to surrender before the appellate court on the judgment dated 24.01.2018 made in C.A.No.89/2017 on the file of III Additional Sessions Judge, Salem CRL.RC.NO.455 OF 2018 [IN CRL.MP.NO.

5523 OF 2018] Order : These petitions coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL.RC.NO.455 OF 2018 on the file of the High Court and upon hearing the arguments of MR.C.S.SARAVANAN Advocate for the petitioner and of MR.R.SURYA PRAKASH Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- Considering the fact that there are arguable points in the revision and taking into consideration, the facts and circumstances of the case and taking note of the fact that the petitioner is the sole breadwinner of his family, the petitioner has paid the fine amount imposed by the trial Court and that he was on bail pending trial, this Court is inclined to suspend the sentence imposed on the petitioner/accused.

2. Accordingly, sentence of imprisonment alone is suspended and the petitioner shall be released on bail on his executing a bond for a sum of Rs.10,000/- with two sureties each for a likesum to the satisfaction of the Judicial Magistrate No.VI, Salem and on a further condition that the petitioner shall report before the trial Court on the first working day of every month at 10.30 a.m, pending disposal of the revision.

3. In view of the suspension of sentence, the petitioner is exempted from surrendering before the appellate Court, Crl.M.P.No.5523 of 2018 is ordered accordingly. -sd/- 06/04/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
