This petition has been filed to enlarge the petitioner on bail pending trial in CC No. 315 of 2021 on the file of the II Additional Special Judge, Special Court under EC and NDPS Act, Chennai.

2. The case of the prosecution is that the respondent found the accused persons with possession of 150 kgs of Ganja. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is a driver, on the alleged date of occurrence he was engaged only to accompany A1 from Rajhmundry to Chennai and he was not aware about contraband. Furthermore, the petitioner has been in custody for more than three years. Hence, he prays to allow this petition.

4. The learned Government Advocate (Crl. side) submits that the contraband seized from the accused person is commercial quantity and also only P.W.2 was examined before the Trial Court. Hence, he raised objection to grant bail.

5. Considering the fact that the contraband seized from the petitioner is commercial quantity and the Trial is at initial stage. Hence, this Court is not inclined to allow this petition. Further, the Trial Court is directed to complete the Trial within a period of three months from the date of receipt of a copy of order. Accordingly, this petition is dismissed. 11.07.2024 pbl
