ORDER

This Criminal Revision case has been filed to set aside the order passed by the learned Judicial Magistrate, Ambattur in C.M.P.No.212 of 2025 by an order dated 03.04.2025, thereby dismissing the application filed by the petitioner seeking direction to register the FIR under Section 156(3) of

Cr.P.C/Section 175(3) BNSS, 2023.

2. Heard the learned counsel on either side and perused the materials available on record.

3. A perusal of records revealed that there was a loan transaction between the petitioner and the proposed accused, for which the proposed accused also issued a cheque and the same was bounced. Aggrieved by the same, the petitioner also initiated proceedings under Section 138 of Negotiable Instruments Act as against the proposed accused and it is pending for trial before the Trial Court.

4. In view of the above, there is no material to register the FIR. Therefore, the Trial Court had rightly dismissed the application filed under Section 156(3) of Cr.P.C and this Court finds no infirmity or illegality in the order passed by the learned Judicial Magistrate, Ambattur in C.M.P.No.212 of 2025 by an order dated 03.04.2025.
