ORDER

The petitioner apprehends arrest for the alleged offences under Sections 126(2), 351(3) and 109 of BNS, in Crime No.55 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that, due to previous enmity, the petitioner along with other accused attacked the defacto complainant with wooden logs and caused cut injuries. Hence, a case has been registered against the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the defacto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.

4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the alleged occurrence took place on 20.05.2026 and that the injured sustained a stab injury and was in the hospital for seven days. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to either side submissions.

6. Taking into consideration the seriousness of the allegations and the injury sustained on the stomach of the injured, this Court is of the firm that grant anticipatory bail to the petitioner at this stage may have an adverse impact on society. Hence, considering the gravity of the offence and its societal impact, this Court is not inclined to enlarge the petitioner on anticipatory bail.
