This is the second bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 31.05.2022 for the offences punishable under Sections 363 and 366 of IPC @ 363, 366 r/w 9 of Child Marriage Act and 5(I) r/w 6 of Protection of Children from Sexual Offence Act in crime No. 6 of 2022 on the file of the respondent police

2. The case of the prosecution is that the petitioner herein under the pretext of marriage had kidnapped the victim girl aged 17 years. Hence, the complaint.

3. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.O.P.No.16562 of 2022, on 18.07.2022, considering the fact that on the compulsion of the petitioner, the victim girl aged 171⁄2 years was kidnapped by the petitioner and was sexually assaulted.

4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner.
