3. The proposed party is aggrieved because his tender has been put to challenge and an interim order has been obtained. Though the affidavit and petition have been served on the learned counsel for the writ petitioner on 18.8.2016, no counter has been filed so far. Since the petitioner herein in a proper and necessary party, this petition is allowed.
