The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 147, 148, 294(b), 324, 506(ii) of IPC subsequently it was altered into under Section 147, 148, 294(b), 324, 302, 506(ii) of IPC, in Crime No.321 of 2024 on the file of respondent police, seeks anticipatory bail.

2. The case of the prosecution is that defacto complainant and the petitioner is a neighbour. On 17.06.2024, the first accused illegally transport the sand without getting any permission from the Government. The wordy quarrel arose between them for which, the petitioner along with other accused attacked the defacto complainant with cricket bat, thereafter the defacto complainant admitted in the Government hospital, thereafter, he died. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case, based on the confession of the arrested accused. drl and he is ready to comply with any condition imposed by this court. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent would raised serious objection stating that there are totally seven accused in this case and the petitioner herein is arrayed as A7. He further submitted that the petitioner was actively participated in the alleged occurrence. He further submitted that the investigation in this case is still pending.

5. Considering the above fact and circumstances of the case and the submissions made by both the counsels and also on considering the gravity of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
