SA.No.956 of 2008 C.KUMARAPPAN, J The learned counsel for the appellant would submit that respondents 4 and 5 are alive. This submission is recorded. The learned counsel for the appellant also filed a Memo stating that R4 is the legal heir of the deceased R3 and hence, prayed to recognise R4 as the legal heir of R3.

R4 is recognised as the legal heir of R3. Registry is directed to carryout the necessary amendment in the appeal Memorandum.
