ORDER

(The case has been heard through video conference) The petitioner, who apprehends arrest for the alleged offence under Sections 294(b), 353 of IPC r/w Section 24(1) of the Cigarette and other Tobacco Products Act, 2003, in Crime No.3158 of 2020 on the file of the respondent police, seeks anticipatory bail. 2.The petitioner is arrayed as A2. The case of the prosecution is that based on special report given by the Special Sub-Inspector of Police, the respondent/Police inspected the house belonging to one Immanuvel (A1) at Singlimedu Village, where they found the petitioner along with other accused involved in selling banned contraband products. Hence, the complaint was registered. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person. He would further submit that he has been falsely implicated in this case and he was in no way connected with the alleged offence. Hence, he prays for grant of anticipatory bail to the petitioner.

4.It is stated by the learned Additional Public Prosecutor (Crl.Side) appearing for the respondent police that the petitioner was found in possession of 167 kilograms of tobacoo product worth of Rs.1.88 lakhs. He would further submitted that there is one previous case in Crime No.306 of 2019, pending against the petitioner and A2 is still in custody. Hence, he vehemently opposed granting of anticipatory bail to the petitioner.

5.Heard both sides and perused the materials available on record.

6.Considering the criminal propensity of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
