ORDER

This writ petition has been filed for the issue of a writ of mandamus directing the 2 nd respondent to issue transit passes to the petitioner to transport and sell flotation rejects from the leasehold land during the lease period of five years from 13.01.2023 to 12.01.2028 as per the relevant rules.

2. The grievance expressed by the petitioner is that all of a sudden the 2 nd respondent stopped issuing transit passes and as a result, the petitioner was not able to transport and sell the flotation rejects and the same has piled up resulting in loss to the petitioner.

3. When the matter was taken up for hearing today, the learned Additional Government Pleader appearing on behalf of the respondents placed the written Page No.2 of 6

instructions given by the 2 nd respondent. The relevant portions are extracted hereunder:

"12. Now, the Government of Tamil Nadu has introduced e-governance in the Mining Department for grant of mineral concessions, issuance of transport permit/dispatch slips/transit passes. Accordingly, from 01.06.2025 onwards the transport permits/dispatch slips/ transit passes obtained by the stockyard holders/ registree been taken into account by the system for issuing of transit passes.

13. If the writ petitioner having old transport permit/dispatch slips/transit passes obtaining for the procurement such mineral/mineral products to her stockyard, the writ petitioner has to produce the same before the Deputy Director of Geology and Mining, Coimbatore, and in turn it may be in consultation with the Commissioner of Geology and Mining for issuance of necessary transit passes to the petitioner."

4. It is clear from the above that, effective from 01.06.2025, such transit passes will be issued only after if it is applied online. Page No.3 of 6

5. It is left open to the petitioner to apply for transit passes through online mode and on receipt of the same, transit passes will be issued to the petitioner to enable the petitioner to transport and sell flotation rejects during the lease period.
