O R D E R

This Criminal Original petition has been filed to quash the FIR in Crime No.09 of 2023 dated 21.02.2023.

When the matter came up for hearing on 17.07.2023, this Court passed the following :- Post this criminal original petition under the caption "for reporting compromise" on 24.07.2023 at 2.15 pm. The 1st respondent shall produce the case diary in this case. In the meantime, the 1st respondent shall also ascertain from the 2nd respondent as to whether there is any compromise between the parties. In any case, the 2nd respondent shall be present before this Court.

Pursuant to the above order passed on 17.07.2023, the matter was taken up for hearing today. The defacto complainant was present at the time of hearing. She was able to speak only in Malayalam language and she was assisted by a counsel. The learned counsel appearing on behalf of the 2/5

2nd respondent submitted that the defacto complainant is not interested in prosecuting the case.

In the considered view of this Court, the allegations that have been made by the defacto complainant are very serious and the investigating officer who was present before this Court submitted that the incriminating videos are infact available and that the same has been sent for expert opinion.

At this stage, the learned counsel for petitioner seeks for the permission of this Court to withdraw this criminal original petition and accordingly, this criminal original petition is dismissed as withdrawn.
