The petitioner namely Kamalraj @ Kamal Bhai, who was arrested and remanded to judicial custody on 28.05.2023 for the offences punishable under Sections 8(c) r/w 20(b)(ii)B of NDPS Act in Crime No.310 of 2023 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is falsely implicated as an accused in Crime No.310 of 2023 for the offences Sections 8(c) r/w 20(b)(ii)B of NDPS. Petitioner is in judicial custody from 28.05.2023. Thus, he prays for grant of bail.

3. The learned Government Advocate (Crl. Side), opposes this petition, on the ground that, on 28.05.2023, on a secret information, respondent police found the petitioner with illegal possession of 1.5 grams of ganja. Petitioner has one similar case pending against him in Crime No.897 of 2021. Therefore, he strongly opposed this petition.

4. Considering the submissions of the learned Government Advocate (Criminal side) that petitioner has one similar case pending 1/3

against him in Crime No.897 of 2021, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
