Respondents Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 3rd respondent Pharmacy of India the forward to the 1st Respondent All India Council for Technical Education its approval to the petitioner's college for offering the B.Pharm degree course and further direct the 1st respondent All India Council for Technical Education to consider giving its 'Letter of Approval' for starting the said course from the academic year 2019-2020. O R D E R

The prayer in the writ petition is to issue a Writ of Mandamus directing the 3rd respondent Pharmacy Council for Technical Education its approval to the petitioner's college for offering B.Pharm degree course and further direct the 1st respondent All India Council for Technical Education to consider giving its 'Letter of Approval' for starting the said course from the academic year 2019-2020.

2. In view of the fact that the Hon'ble Supreme Court has seized of the issue regarding considering the affiliation and permission for Pharmacy College and dead line has been fixed and extension of time was also expired on 10.06.2019. The request of the petitioner was dismissed since the petitioner has submitted his affidavit on 12.06.2019 two days late.

3. This Court is not inclined to entertain this writ petition since the matter has already been seized of by the Hon'ble Supreme Court. If any grievance regarding non-acceptance of the affidavit by All India Council for Technical Education and Pharamacy Council of India on the ground of delay the petitioner has to work out his remedy for extension of time before the

Hon'ble Supreme Court in Miscellaneous Application No.1068 of 2019 in Civil Appeal No.9048 of 2012 [Parshavanath Charitable Trust & Ors. v. All India Council for Technical Education & Ors.].
