There is no appearance on behalf of the petitioners. The petitioners are the accused Nos. 2 to 4 in Cr.No. 557 of 2023 registered under Sections 406, 420 and 506(i) of IPC.

2. The matter has been listed on 05.10.2023, 13.10.2023, 08.11.2023, 05.12.2023, 12.12.2023 and finally on 19.12.2023.

3. It is seen that the learned counsel for the petitioners had taken a conscious decision not to appear and represent the case.

4. It is the case of the prosecution that there are totally five accused and that the first accused is the manager in a private bank and the accused had promised that they would arrange loan of Rs.5/- crores to the defacto complainant and that he should pay commission of Rs.15/- lakhs. It is stated that the accused persons went over to the house of the defacto complainant and took away Rs.50,000/- in the first instance and later, forced him to part with another sum of Rs.14.50 lakhs. Taking the nature of the offence and the fact that the investigation can never even commence in the absence of the accused, this Criminal Original Petition seeking anticipatory bail stands dismissed.
