ORDER
The petitioner, who was arrested and remanded to judicial custody on 17.06.2024, for the offence punishable under Section 232 (a), 103 (1), 64 (1) of BNS, in S.C.No.185 of 2025, pending before the learned Principal Sessions Judge, Chennai, seeks bail. 2.The case of the prosecution is that, the petitioner had entered into the defacto-complainant's house and assaulted her mother using wooden log and caused grievous injuries to her. Due to
this said attack, the victim sustained grievous head injury and the medical persons came in 108 Ambulance informed that the victim was dead. The accused was identified through CCTV footage. Hence the case.
3.The contention of the learned counsel for the petitioner is that the petitioner is an innocent person and he has been falsely implicated in this case. The petitioner is in judicial custody from 17.06.2024 and that further custodial interrogation of the petitioner is not required. Hence, he prays for grant of bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing the grant of bail to the petitioner, reiterated the prosecution case and on instructions submitted that the petitioner had entered into the victim's house and sexually assaulted her, due to which she died on the spot. He further submitted that final report has been received in which it is opined that there are evidences suggestive of vaginal intercourse. He further submitted that trial is pending before the learned Sessions Judge, Mahila Court, Chennai, in S.C.No.185 of 2025.
5.Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record. 6.Considering the nature of the offence, the submission of learned Government Advocate
(Criminal side) and the fact that the trial is not yet completed, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. The trial court is directed to complete the trial within a period of six months from the date of receipt of copy of this order.
