This petition has been filed to enlarge the petitioner on bail in CC No. 226 of 2024 on the file of the I Additional Special Court for Exclusive Trial of Cases under NDPS Act in crime No. 29 of 2024 on the file of the respondent police.
2. The case of the prosecution is that the respondent found the accused persons with possession of 60 kgs of Ganja. Hence, the case.
3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and also co-accused has been released on bail. Hence, he prays to allow this petition.
4. The learned Government Advocate (Crl. side) submits that the contraband seized from the accused person is commercial quantity and also the petitioner is having one 302 IPC case. Hence, he raised objection to grant bail.
5. Considering the fact that the contraband seized from the petitioner is commercial quantity and also the petitioner is having one 302 IPC case. Hence, this Court is not inclined to allow this petition. Accordingly, this petition is dismissed.
