ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present writ petition is filed praying for a writ of mandamus to direct the 2nd respondent to dispose the petitioner's appeal dated 07.01.2025, pending on the file of the 2nd respondent, preferred against the impugned order passed by the 3rd respondent in Na.Ka.No.A2/1708/ 2024 dated 17.12.2024 and to dispose the same within a time frame to be fixed by this Court.
3.It is the case of the petitioner that he is a senior citizen aged about 73 years and belonged to Arundhathiyar Community, which is a schedule caste community. He served in Indian Army in the cadre of 2/5
Sub/Hony. Captain and retired from service on 30.04.1997 and receiving Rs.1,270/- as pension. Presently, he is working as agricultural coolie and earning Rs.30,000/- per annum.
4.At the outset, learned Additional Government Pleader for respondents would submit that they would consider and dispose of the appeal dated 07.01.2025 in accordance with law, within a time frame to be fixed by this Court.
5.In view thereof, the writ petition is disposed of with a direction to the 2nd respondent to dispose of the appeal filed by the petitioner dated 07.01.2025, after affording reasonable opportunity of hearing to the petitioner, and any other interested parties/rival claimants, if any, within a period of 16 weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the appeal and it is open to the concerned respondent to consider the same on its own merits and in accordance with law. There shall be no order as to costs.
