This Criminal Original Petition has been filed by the petitioner/ A1, who was arrested and remanded to judicial custody on 13.06.2024, seeking bail in Crime No.321 of 2024 registered for the offence under Sections 294(b), 323, 324, 506(ii) of IPC @ Section 304(ii) of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner aged about 21 years, is an innocent person and he has been falsely implicated in this case. He further submitted that there was a quarrel between the victim/deceased, who was grazing ducks, and the petitioner and his friend, during which, he fell down and sustained injuries. He also submitted that there is no intention or motive for the petitioner to assault him and the incident was happened only during the quarrel. He further submitted that the petitioner has been suffering incarceration from 13.06.2024, hence, he prayed to grant bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that, the victim/deceased was working under the de facto complainant for grazing ducks. On 09.06.2024, there was a quarrel between the accused and the victim, during such time, the accused had pushed the victim down, due to which, he sustained injuries and died without responding to the treatment, thereby, the accused had committed culpable homicide. He also submitted that the investigation is at initial stage.

4. Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and taking note of the fact that the investigation in this case is not yet completed, this Court is not inclined to grant bail to the petitioner.
