This writ petition has been filed challenging the impugned proceedings of the 2nd respondent dated 11.04.2018 confirming the proceedings of the 3rd respondent relating to the sale deed dated 11.12.2017 and to direct the 3rd respondent to register the sale deed executed in favour of the petitioner.
2.Heard the learned counsel for the petitioner and the learned Special Government Pleader for respondents 1 to 3. 3.The 3rd respondent has refused to register the sale deed by assigning some reasons which are available in the impugned proceedings dated 11.01.2018. The main reason that has been assigned is that a complaint has been given before the Crime Branch and enquiry was 2/4
pending. That apart, a partition suit is pending in O.S.No.147 of 2017 before the District Court, Cuddalore. All the other reasons can be explained by the petitioner by incorporating proper recitals. 4.The learned counsel for the petitioner submitted that the suit has already been dismissed for default and the police complaint that was given has also been closed. In view of the same, the petitioner can give necessary clarification in the sale deed with respect to the other defects that were pointed out by adding necessary recitals and the sale deed shall be represented for registration before the 3rd respondent and the same shall be registered, if it is otherwise in order. 5.In the result, this Writ Petition is disposed of with the above directions. Consequently, the connected Miscellaneous Petition is closed. No costs.
