A.No.3337 of 2024 in C.S.(Comm. Div.)No.213 of 2022 SENTHILKUMAR RAMAMOORTHY,J By this application, the 5th defendant seeks to set aside order dated 20.06.2024. In the affidavit in support of this application, it is stated that the proof affidavit was not filed within the specified time limit in view of the efforts that were being made to settle the dispute amicably by exchanging settlement proposals.

2. Learned counsel for the plaintiff submits, on instructions, that he has no objection to this application being allowed.

3. Upon examining the reasons set out in the affidavit and being satisfied that sufficient cause is shown, order dated 20.06.2024 setting the 5th defendant ex parte is hereby set aside.
