This writ petition is filed under Article 226 of the Constitution of India, seeking writ of mandamus directing the respondents herein to consider and pass orders on the petitioner's representation dated 22.09.2022 regarding to cancellation of the punishment order in PR.47/2012 punishment of "Postponement of next one year without cumulative effect" and granting of promotion to the post of Sub-Inspector of Police on par with his batch mates. Order This writ petition is filed for the following relief: "To direct the respondents herein to consider and pass orders on the petitioner's representation dated 22.09.2022 regarding to cancellation of the punishment order in PR.47/2012 punishment of "Postponement of next one year without cumulative effect" and granting of promotion to the post of Sub-Inspector of Police on par with his batch mates."
2. The petitioner joined the respondent department on 27.11.2000 as Grade II Police Constable. The grievance of the petitioner is that she was imposed with a punishment of postponement of next one year without cumulative effect, by order dated 16.10.2012. The petitioner would submit that she took medical leave and the aforesaid unauthorised absence of 8 months was not intentional or meant to avoid duty. Therefore, the petitioner sent a representation dated 22.09.2022, seeking cancellation of the punishment. Since there is no response, the petitioner is before this Court.
3. Considering the facts and circumstances of the case and the fact that the petitioner's representation dated 22.09.2022 has not been considered to date, a direction is issued to respondents to consider the petitioner's representation
and pass orders on merits and in accordance with law, within a period of 8 weeks from the date of receipt of a copy of this order.
