This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 20.06.2024, seeking bail in Crime No.340 of 2024 for the alleged offences punishable under Sections 294(b), 392 & 397 of IPC and Section 3 of Tamil Nadu Public Property (Prevention of Damage and Loss) Act.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and a false complaint has been given against him only for the statistical purpose. He further submitted that the petitioner is in custody from 20.06.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that the petitioner, who is a habitual offender against whom, 13 previous cases including the cases registered under Section 307 IPC are pending, has waylaid the de facto complainant, abused him in filthy language and at knife point, taken away a sum of Rs.200/- from his auto and also damaged the windshield of his auto. He also submitted that the investigation in this case is still pending, therefore, if he is released on bail, there is a possibility of him absconding and would threaten the de facto complainant.

Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) and taking note of the fact that the investigation in this case is still pending and also considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
