PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the third respondent Government respondent to cancel Patta No.839 standing in the name of the fourth private respondent and alternatively, issue the same in the petitioner's name based on the petitioner's complaints dated 08.04.2024 and 11.12.2024. This writ petition has been filed seeking issuance of a writ of mandamus directing third respondent to consider the complaints lodged by petitioner on 08.04.2024 and 11.12.2024 wherein the petitioner has sought for cancellation of patta that stands in the name of fourth respondent.
2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed, notice to fourth respondent is dispensed with.
3. The case of the petitioner is that she is the lawful owner of immovable property comprised in Survey No.84/3B1 measuring an extent of
2.51 cents situated at Nariyamangalam Village, Kilpennathur Taluk, Tiruvannamalai District and the same was purchased from one Murugan vide sale deed dated 09.11.2011 registered as Document No.2537 of 2011. The said property was subdivided into Survey No.84/3B1A measuring an extent of 2.36 cents and Survey No.84/3B1B measuring an extent of 0.15 cents. It is stated that insofar as Survey No.84/3B1A is concerned, Patta No.785 was issued in the name of petitioner. In respect of Survey No.84/3B1B, Patta No.839 was issued in favour of fourth respondent, who according to petitioner has no right over the subject property. Petitioner had thus lodged a complaint on 08.04.2024 to official respondents to cancel the patta and the same was forwarded to third respondent vide letter dated 17.05.2024. As it did not evoke any response, petitioner had once again lodged a complaint on 11.12.2024 to second respondent. Since the same was not considered, the present writ petition has been filed.
4. At the outset, it was submitted by learned Special Government Pleader for respondents 1 to 3 that the complaint dated 11.12.2024 lodged
by petitioner would be considered and appropriate orders would be passed within a time frame to be fixed by this Court, which was agreed to by learned counsel for petitioner.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to concerned respondent, to consider the complaint dated 11.12.2024 lodged by petitioner on its own merits and pass appropriate orders in accordance with law within a period of twelve weeks from the date of uploading of the web copy without waiting for the receipt of certified copy, after affording reasonable opportunity of hearing to petitioner, fourth respondent and any other interested persons. It is made clear that this Court has not expressed any view with regard to the merits of the case and it is open to the concerned respondent to consider the complaint on its own merits and in accordance with law.
