Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents herein to consider the petitioner's representation dated 21.02.2025 and further direct the respondents herein to take immediate steps to prevent flow of sewage water from the drainage on the Southern side of the Erode to Sathy Main Road into the North-South 40 feet road which is running in front of the 1 /6
petitioner's house in S.F.No.279/1 of Periya Semur Village and further direct the 2nd respondent herein properly maintain the 40 feet road and the drainage on the either side and remove the stagnated sewage water in front of the petitioner's house, within a time frame fixed by this court. ORDER
The writ petition is filed for a Mandamus directing the respondents to consider the representation dated 21.02.2025 and consequentially to direct the respondents to take immediate steps to prevent the sewage water from the drainage on the southern side of the Erode to Sathy main road into the north south 40 feet road running in front of the petitioner's house in S.F.No.279/1 of Periya Semur Village and to further direct the 2nd respondent to maintain 40 feet road and the drainage on the either side and remove the stagnated sewage water in front of the petitioner's house.
2. Today, when the matter is taken up for consideration, the learned counsel appearing for the 2nd respondent submitted a letter of the Executive 2 /6
Engineer, Erode Municipal Corporation dated 18.06.2025, stating that inspection was conducted in the month of April, 2025, on the feasibility of providing SWD and on the basis of the instructions of the Additional Collector/Project Director, DRDA, Erode District, in his proceedings dated 30.05.2025, it was decided to proceed with the preparation of the estimate. It was further submitted that the feasibility report along with the estimated amount for Rs.15 lakhs was submitted for sanction of amount under MLACD Fund vide E1/4907/2024 dated 18.06.2025. Learned counsel further submitted that after obtaining Administrative sanction from the competent authority and finalizing the tender process, work order will be issued and work completed in due course. The learned counsel for the second respondent prayed for reasonable time to commence the work of the SWD.

In view of the submissions made by the learned counsel for the 2nd respondent, three months time, from the date of receipt of a copy of this order, is granted to the 2nd respondent, to get the administrative sanction, for the Estimate submitted by the Executive Engineer, Erode Municipal Corporation. On receipt of the administrative sanction within the stipulated period, the work should be completed within 6 months thereafter. 3 /6
4. In the result, this writ petition is disposed of with the above direction. No costs.
