A.No.3392 of 2022 in T.O.S.No.7 of 2000 N.SESHASAYEE, J., The sole plaintiff has passed away and this application is taken out by the applicant who is one of her legal heirs to implead himself as the proposed plaintiff and also to implead her other legal heir, the sister of the applicant as the proposed fifth defendant in the suit. It is reported that notice to the proposed fifth defendant was returned with an endorsement 'unclaimed' and AOS was filed in Court.

2. Service to the proposed fifth defendant is held sufficient and this application is allowed.

3. Registry is directed to carry out necessary amendment in the main suit today.
