ORDER : The Court Made the following order :- The petitioners who were arrested and remanded to judicial custody on 17.08.2021 for the offence under Section Girl Missing, Sections 366(A), 344, 452 of I.P.C. r/w. Sections 5(1), 6, 13, 14 and 17 of POCSO Act and Sections 9 and 10 of Child Marriage Act in Cr.No.269 of 2021 on the file of the respondent police, seeks bail. 2.It is the case of the prosecution that A1 is alleged to have threatened the minor victim girl that he will kill her parents if she does not come to his house and thereafter, the victim girl went to A1's house and A1 married her without her consent. The petitioners are alleged to have compelled the victim girl and performed her marriage with A1.
3.The learned counsel appearing for the petitioners would submit that the petitioners have not committed any offence as alleged by the prosecution.
4.The learned Government Advocate (Crl. Side) would submit that earlier, the petitioners approached this Court by filing Crl.O.P. No.16757 of 2021 and this Court has dismissed the said petition. https://hcservices.ecourts.gov.in/hcservices/
5.Considering the nature of the offence committed by the petitioners and since there is no change in circumstances subsequent to the order passed in Crl.O.P.No.16757 of 2021, this Court is not inclined to grant bail to the petitioners.
