ORDER

The petitioner was convicted by order dated 25.02.2026 in S.T.C.No.5005 of 2015 on the file of the XXVII Metropolitan Magistrate, 1/4

Saidapet, Chennai for the offence under section 138 of the Negotiable Instruments Act, 1881 and was sentenced to undergo two years simple imprisonment and to pay compensation of Rs.10,00,00,000/- within a period of two months and in default to undergo 3 months simple imprisonment. 2.It is the contention of the learned counsel for the petitioner that aggrieved against the said judgment, the petitioner filed an appeal in C.A.No.446 of 2026 on the file of the XXI Additional Sessions Court at Allikulam, Chennai and also filed a petition seeking for suspension of sentence in Crl.M.P.No.1 of 2026. The suspension of sentence was granted on 30.03.2026 with a condition to the petitioner to deposit 20% of the compensation amount to the credit of STC No.5005 of 2015 within 30 days. Thereafter, the petitioner preferred Crl.OP.No.

10564 of 2026 seeking to set aside the said condition or in alternative to substantially reduce the quantum of deposit. This court by order dated 28.04.2026 dismissed the petition and directed the petitioner to pay 20% of the cheque amount, i.e., Rs.1,00,00,000/- on or before 01.06.2026 as directed by the lower appellate court.

3.It is further submitted by the learned counsel for the petitioner that the petitioner is taking steps to arrange for mobilising the funds and therefore, requested for extension of time.

4.Considering the submissions made and in the light of the facts and circumstances of the case, the petitioner is granted two weeks time from the 2/4

date of receipt of the copy of this order to deposit the 20% of the cheque amount as directed by the lower appellate court. It is made clear that no further extension will be granted. In the event of the petitioner not complying with the condition within the stipulated period, the suspension of sentence granted by the learned XXI Additional Sessions Judge, Allikulam shall stand cancelled automatically. Accordingly, this criminal miscellaneous petition is ordered. No costs.
