ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present writ petition is filed praying for a writ of mandamus to direct the respondents to consider and dispose of petitioner's representation dated 31.07.2023 along with reminder dated 16.12.2024, for issuance of patta in respect of property bearing Plot No.261, Sri Kapaleeswarar Nagar, Neelangarai, within a time frame to be fixed by this Court.
3.It is submitted by the learned counsel for the petitioner that the petitioner is the absolute owner of the property bearing Plot No.261, situated at Sri Kapaleeswarar Nagar, Neelangarai, Chennai, forming part of a duly sanctioned layout in LPDM/D.T. & C.P.No.24/1974, and comprised in Old S.No.91/2A, which now corresponds to New S.No.91/2A1A1A1 A1E, Neelangarai Village, formerly part of Tambaram Taluk, Kancheepuram District, and now falling within the 2/6
jurisdiction of Sholinganallur Taluk, Chennai District. The said property measures an extent of 1 ground and 400 sq.ft. (i.e.2800 sq.ft). It is further submitted that the petitioner purchased the said property under a registered Sale Deed dated 30.03.1992, bearing Document No.1486/1992 before the Sub- Registrar Office, Adyar, and ever since the date of purchase, the petitioner is in peaceful possession and continuous enjoyment of the same.
4.On verifying the online revenue records from the Official Government portal i.e., https://eservices.tn.gov.in, petitioner found that Patta No.1133 is not reflected online, instead S.No.91/2A1A1A1 A1E is wrongly shown as part of Patta No.6845 in the names of Mr.R.Bharathkumar and Mrs.R.Sakthirekha, who are the owners of adjacent Plot No.257.
5.It is further submitted by the learned counsel for the petitioner that petitioner submitted a representation on 31.07.2023 seeking issuance of patta. However, above representation and reminder dated 16.12.2024 have not been considered so far by respondents. Aggrieved by the same, the petitioner has come before this Court.
6.At the outset, it was submitted by the learned Additional 3/6
Government Pleader for respondents that the representation dated 31.07.2023 along with reminder dated 16.12.2024, made by petitioner would be considered and appropriate orders would be passed within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.
7.In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the respondents, to consider the representation dated 31.07.2023 along with reminder dated 16.12.2024 on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner, Mr.R.Bharathkumar & Mrs.R.Sakthirekha and any other interested persons/stake holders, within a period of 12 weeks from the date of uploading of this order. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.
8. Accordingly, the writ petition stands disposed of. No costs. 4/6
