This Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 1st respondent to consider the petitioner's representation dated 14.10.2020 and consequently, direct the respondent to sub-divide the petitioner's husband land in respect of property situated in S.No.333/33B admeasuring extent of 50 cents land in S.No.333/33B Parali Village, Mohanur Taluk, Namakkal District with joint Patta No.645 and to issue separate patta in the petitioner husband name Ponnusamy, son of Kandasamy.

ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the respondents to consider the representation made by the petitioner on 14.10.2020, wherein the petitioner is seeking for a separate patta with respect to the subject property.

Mr.E.Balamurugan, learned Special Government Pleader appearing on behalf of the respondents submitted that the second respondent has already fixed a date for an enquiry on 21.12.2020 https://hcservices.ecourts.gov.in/hcservices/

at 4.00 p.m. The learned counsel further submitted that the petitioner can be present at the time of enquiry along with all the relevant documents.

Taking into consideration the facts and circumstances of the case and also of the fact that the second respondent has already called the parties for enquiry, there shall be a direction to the second respondent to conduct enquiry after giving an opportunity to the petitioner and any other interested parties and pass orders strictly in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

This Writ Petition is disposed of with the above directions. No costs.
