ORDER
The present Writ Petition has been filed seeking a direction to the respondents to return the tender deposit amount of Rs.1,45,000/- together with interest to the petitioner, as per order passed by the 1st respondent in his proceedings Na.Ka.No.4848/ 2021/A7 dated 30.03.2025.
2. Mr.P.Siddarth, learned Government Counsel takes notice for the respondents.
3. The petitioner is a registered contractor in the Government Departments as well as Panchayat/District Rural Development Agencies. The petitioner was awarded a contract pursuant to the tenders called for by the 2nd respondent for maintaining the roads called as periodical renewal of PMGSY roads for the year 2016-2017. As per the tender conditions, the petitioner made a security deposit of Rs.1,45,000/- in favour of the 2nd respondent. It is his grievance that, even after the expiry of the contract period as also the completion of contract work, till date, the respondents have not refunded the security deposit made by him. Therefore, the petitioner submitted a representation to the 1st respondent seeking refund of security deposit. Pursuant thereto, the 1st respondent, vide proceedings dated 30.03.2026 had directed the 2nd respondent to refund the security deposit of Rs.1,45,000/- to the petitioner. However, till date, the said order has not been implemented by the 2nd respondent. Hence, the present Writ Petition.
4. Learned counsel appearing for the petitioner submitted that it would suffice, if this Court issues a direction to the 2nd respondent to implement the order passed by the 1st respondent within the reasonable time that may be stipulated by this Court.
5. On the above contention, this Court heard the learned Government Counsel appearing for the respondents who has no objections to the said order being passed.

In view of the limited relief sought for in this Writ Petition, this Court without expressing any opinion on the merits of the case, directs the 2nd respondent to implement the order passed by the 1st respondent dated 30.03.2025 by refunding the security deposit of Rs.1,45,000 to the petitioner, within a period of six (6) weeks from the date of receipt of a copy of this order, if there is no legal impediment.
7. The Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
