ORDER

The petitioner apprehends arrest for the alleged offence under Sections 296(b), 115(2), 118(1), 351(3) of BNS, 2023, in Crime No.80 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the petitioner, along with other accused, abused the defacto complainant in filthy language and assaulted the defacto complainant. Due to this, the defacto complainant sustained injuries and was admitted to the hospital. Hence, the case.

3. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that the previous applications were dismissed on 12.03.2026 and 20.04.2026 respectively; that there is no change in circumstances; and that the defacto complainant was in the hospital for more than one month. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent. 5.The learned Government Advocate (Crl.Side) would submit that the previous applications were dismissed on 12.03.2026 and 20.04.2026 and there is no change in circumstances, and apart from that, he would submit that the defacto complainant was in the hospital for more than one month. Hence, considering the seriousness of the injury and severity of the allegation, this

Court has dismissed the applications on 12.03.2026 and 20.04.2026. Unless there is a substantial change in ground, the question of entertaining the subsequent application does not arise. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
