ORDER

The petitioners apprehend arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 118(2), 351(3) of BNS, 2023 in Crime No.Not known of 2026, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioners is that, during a Panchayat Union meeting held on 19.05.2026, a quarrel arose between the parties, pursuant to which, the petitioners allegedly abused the defacto complainant in filthy language and referred to him by his caste name in public view, thereby threatening him. Hence, the case.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and have been falsely implicated in this case due to political rivalry. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the alleged occurrence took place in public view during a Panchayat Union meeting on 19.05.2026 and that specific overt acts against the petitioners is that they abused the defacto complainant by referring to his caste name. He further submitted that the case has been registered in Crime No.53 of 2026. Hence, he opposed to grant anticipatory bail to the petitioners.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. In view of the specific allegations attracting the provisions of the SC/ST (Prevention of Atrocities) Act and the statutory bar contained under Section 18 of the said Act, this Court is not inclined to entertain the present application seeking anticipatory bail. Accordingly, this Criminal Original Petition is dismissed.
