THE HONOURABLE MR.JUSTICE S.M.SUBRAMANIAM Vasantha ... Petitioner Vs.

1.The District Collector, O/o. The District Collector, Nagapattinam District, Nagapattinam.

2.The Executive Engineer, Public Works Department and Water Sources Department, (PIU - 1), Vennaru Drainage Basin Division, Thiruvarur, Thiruvarur District.

... Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 2nd respondent to implement the proceedings in Letter No.02M/VaPi/Va2/Co.100(Aavava) ADR/2019 dated 03.01.2020 on the file of the 2nd respondent and direct the 2nd

respondent to allot the house site in the same locality or to pay the compensation to the petitioner within stipulated time may fixed by this Court. For Petitioner : Mr.R,Muruga Bharathi For Respondents : Mr.G.Krishna Raja Additional Government Pleader

O R D E R

The learned Additional Government Pleader appearing on behalf of the respondents made a submission that the petitioner had received the compensation and it has been stated in the counter affidavit filed by the 1st respondent. The relevant paragraph is extracted hereunder: "7. The Government has also deposited through ECS a sum of Rs.3,59,053/- (Building cost Rs.3,48,053/- and Livelihood charges Rs.6000/-, Transportation charges Rs.5000/-) on 16.03.2021 in the petitioner's saving account maintained by her in Bank of Baroda, Thalainayar Branch in Account No.05360100002461 towards compensation payable to her. Thus the prayer sought for by the petitioner either to disburse the compensation or to allot a house does not arise at all and the prayer sought by the petitioner is

redundant and infructuous. The allegations levelled by the petitioner against the Government as if her livelihood has become a question mark do not have even an iota of truth."

2. In view of the fact that grievance of the petitioner has been redressed, no further adjudication is required and consequently, this Writ Petition stands disposed of. No costs.
