Order This writ petition has been filed seeking the issuance of a writ of mandamus directing the 1st respondent to consider the representation dated 24.04.2026 submitted by the petitioner with respect to sanctioning additional pension to the provisional pensioner.

2. It is the case of the petitioner that he was working as an Assistant Divisional Engineer in the Highways Department and retired on 30.06.1999. The petitioner is drawing provisional pension as the disciplinary proceedings initiated in the year 2015 is still pending before the Special Court, Salem. The petitioner attained the age of 80 years and claims that he is entitled to additional pension. He would further submit that the Government has already permitted revision of provisional pension and payment of increased dearness allowance even before the conclusion of the disciplinary proceedings vide G.O.Ms.(3D) NO.6,Dt 22.01.2015 (Copy enclosed). However, the benefit of additional pension has not been extended to him.

According to the petitioner, additional pension is an age-related benefit and cannot be denied merely because disciplinary proceedings are pending. He further states that he is facing financial hardship and requires the additional pension for his livelihood and medical expenses.

Though several representations were submitted including the latest representation dated 24.04.2026, no action has been taken by the respondents. Hence, the present writ petition has been filed seeking the aforesaid relief.

3. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for respondents.

Considering the limited scope of the prayer sought in this writ petition, and without expressing any opinion on the merits of the case, this Court directs the 1strespondent to consider the petitioner's representation dated 24.04.2026 and pass appropriate orders on merits and in accordance with law, taking into consideration G.O.Ms.No.313, Finance (Pay Cell) Department, dated 25.10.2017, within a period of four weeks from the date of receipt of a copy of this order.
